By submitting our webinar registration form, you are entering into an agreement with Mark DiMercurio and 1031 Capital Solutions. Please review the following terms carefully — they describe how we will communicate with you, the third-party platforms we rely on, and your rights to opt out at any time.

Section 01

Webinar Communications & Consent

By submitting the registration form, you consent to receive webinar-related communications from Mark DiMercurio and 1031 Capital Solutions. These communications may include:

  • Registration confirmations acknowledging that your seat has been reserved.
  • Reminder emails in the days and hours leading up to the live session.
  • Webinar access information, including the join link, dial-in details, and event timing.
  • Follow-up communications after the event, such as the recording and any presenter materials.
  • Educational content related to Delaware Statutory Trusts (DSTs) and 1031 exchanges.

These communications are provided as part of your registration. You may unsubscribe from non-essential educational content at any time using the link in any email.

Section 02

Third-Party Service Providers

To deliver the webinar and manage communications, your information may be securely processed through trusted third-party platforms, including:

  • n8n — used for registration intake and workflow automation.
  • Wealthbox — used for CRM and client records.
  • Resend — used for email delivery.
  • JustCall — used for business phone and SMS messaging.
  • Livestorm — used for webinar hosting, attendee access, and event management.

Each provider maintains its own privacy and security practices. By submitting the form you authorize 1031 Capital Solutions to transmit the information you provide to these platforms strictly for registration, communication, and event-management purposes related to the webinar.

Note

We do not sell your personal information. Data shared with these providers is used only to operate the webinar and follow-up communications you have consented to receive.

Section 03

SMS & Text Message Consent

By providing your phone number, you consent to receive informational text messages related to your webinar registration and reminders. These messages are intended to ensure you receive timely access to the event.

Message & Data Rates May apply per your carrier plan
Opt Out Reply STOP at any time to unsubscribe
Help Reply HELP or contact us directly

You may opt out of SMS messages at any time without affecting your webinar registration or your ability to receive email communications.

Section 04

Phone Call Policy

You will not receive phone calls prior to the webinar unless you explicitly opt in to be contacted — for example, by selecting "Yes" when asked whether you would like to set up a call with an advisor, or by scheduling a time directly through the calendar tool on our registration form.

If you do not opt in, your phone number will be used solely to deliver the SMS reminders described in Section 03.

Section 05

Post-Webinar Follow-Up

Following the webinar, a representative of 1031 Capital Solutions may contact you to answer questions or discuss educational information related to the webinar topic, including 1031 exchanges and Delaware Statutory Trusts.

Any such follow-up is informational in nature. You are under no obligation to engage further, schedule a meeting, or invest in any product. You may request to be removed from follow-up contact at any time using the methods described in Section 09.

Section 06

Educational Purpose Only

The webinar and all related communications are intended strictly for educational and informational purposes. They do not constitute an offer to buy or sell any security, an offer of investment advisory services, or a recommendation to engage in any particular transaction.

Securitized real estate investments referenced in the webinar are offered only through the sponsor's Private Placement Memorandum (PPM), which is available solely to accredited investors. Neither 1031 Capital Solutions nor Concorde Investment Services, LLC provides tax or legal advice — you should consult your accountant and/or attorney regarding your individual situation. Section 07

Eligibility

By submitting the registration form, you represent that you are at least 18 years of age and a resident of the United States. The webinar content is geared toward U.S. investment-property owners and may not be relevant or appropriate for audiences outside that scope.

1031 Capital Solutions reserves the right to refuse registration, decline attendance, or remove participants from the event at its sole discretion.

Section 08

Use of Your Information

Information you provide — including your name, email address, phone number, and answers to qualifying questions on the registration form — will be used to:

  • Confirm your registration and deliver event access.
  • Send the reminders and educational content described in Section 01.
  • Facilitate optional follow-up conversations you have requested.
  • Improve and personalize our webinar programming.

Section 09

Your Rights & How to Opt Out

You may withdraw your consent or opt out of any communication channel at any time:

  • Email: click the "unsubscribe" link at the bottom of any email we send.
  • SMS: reply STOP to any text message.
  • Phone: ask the representative to remove you from contact, or email the address below.
  • All communications: email mark@1031capitalsolutions.com with the subject line "Opt Out."

Opting out of marketing or educational content will not affect transactional communications required to deliver a webinar you are actively registered for (e.g., the access link or a same-day reminder).

Section 10

Changes to These Terms

1031 Capital Solutions may update these Terms & Conditions from time to time to reflect changes in our practices, our service providers, or applicable law. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you by email.

Your continued use of our webinars or services after a revised version is posted constitutes acceptance of the updated terms.

Section 11

Governing Law

These Terms & Conditions are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these terms will be resolved exclusively in the state or federal courts located in San Diego County, California.
